Code of Conduct

The intention of this policy is to establish clear and acceptable behavior expectations for College Greens Swim & Racquet Club (“Club”) members, guests, employees, volunteers and spectators. It is not intended to restrict the rights of anyone but rather to ensure that all those on Club property or at Club events can expect to be treated with respect. The Club deems that upon acceptance into membership and/or entry onto Club property, all members, guests, employees, volunteers, and spectators have given their consent to be bound by both the restrictions and penalties imposed by this code of conduct.

Code of Conduct 

All members, guests, employees, volunteers, and spectators shall: 

  • Always show respect for other members, guests, employees, volunteers and spectators. 
  • Never yell, taunt, threaten or perpetrate physical violence upon another member, guest, employee, volunteer or spectator. Members or others with a legal restraining order against them by a member may be barred from membership, visitation, or participation in any Club activity. 
  • Never use abusive or vulgar language or make racial, ethnic, or gender-related slurs or derogatory comments at the Club or during Club events. 
  • Always show respect for Club property and the property of other members, guests, employees, volunteers, and spectators. Vandalism in any form will not be tolerated and the offending Club member or Club member parent will be held financially responsible for any damages incurred by the Club. 
  • Refrain from public displays of affection that could make others uncomfortable. This applies to adults as well as teens on Club property. 
  • Never engage in harassment of any kind against a Club member, guest, employee, volunteer, or spectator. Prohibited harassment includes verbal, physical, and visual conduct that creates an intimidating or offensive environment or that interferes with an individual’s wellbeing or performance. Harassing conduct can take many forms and may include, but is not limited to, the following: slurs, jokes, statements, gestures, assault, impeding or blocking another’s movement or otherwise physically interfering with normal movements, pictures, drawings, or cartoons, violating someone’s “personal space,” foul or obscene language, leering, stalking, staring, unwanted or offensive letters or poems, offensive email, text, or voicemail messages. Sexually harassing conduct in particular may include all of these prohibited actions, as well as other unwelcome conduct, such as requests for sexual favors, conversation containing sexual comments, and other unwelcome sexual advances. Sexually harassing conduct can be by a person of either the same or opposite sex. Harassing conduct need not be motivated by sexual desire to be violative of this policy.
  • Report violations of this Code of Conduct to the Board in writing. Immediate concerns should always be directed to a lifeguard, who will contact a Board member. 

Resolution of violations 

  • Any person violating this policy may be removed from the Club premises at the time of the violation by any Board member or managing lifeguard. 
  • Should the Board be made aware of a violation after the fact, it will be put on the agenda of the next Board of Directors meeting for discussion. 
  • The Board may issue a warning, bar from the premises, discipline, suspend or expel a violator, depending on the circumstances of the violation and the violator’s status (member, guest, volunteer, employee, or spectator). 
  • If the violation rises to the level where suspension of or expulsion from membership may be considered, the due process procedure in the Club bylaws will be followed.

Consent to Electronic Transmission

As a member of the College Greens Swim and Racquet Club, Inc. (CGSRC) and/or a director on the CGSRC Board of Directors, you must provide written consent in order to receive official communications from, and/or to send official communications to, CGSRC by electronic transmission (i.e. fax or email).

This consent form will allow CGSRC to send you meeting notices, ballots, conduct meetings, and handle other official business that requires member or board approval, by electronic transmission. It also allows you to send the same types of information to CGSRC via electronic transmission.

Before signing this consent form, please review and be aware of the following:

  1. You are not required to sign this form. You may request that meeting notices, ballots, and other matters of official business be sent to you via regular mail.
  2. You have the right to withdraw your written consent at any time after signing this form by providing CGSRC with written notice that you are withdrawing your consent relative to electronic transmission. No fee will be charged for withdrawing your consent.
  3. This consent to electronic transmission is broad, and may include transmission of meeting notices, ballots, and other important information regarding CGSRC. It also allows CGSRC to conduct meetings via electronic transmission, although that will not be a frequent occurrence. This consent form represents consent under both California Corporations Code 20 and 21 (transmission from and to CGSRC). This consent form also meets the requirements for consent under the federal Electronic Signatures in Global and National Commerce Act (15 U.S.C. Sec. 7001(c)(1)).
  4. Consenting to electronic transmission via fax requires that you have access to a fax machine and have a current fax number on file with CGSRC.
  5. Consenting to electronic transmission via email requires that you have access to a computer, have a current email account in your name, and have provided your current email address to CGSRC.

I have read and understand the foregoing, and hereby provides this un-revoked written consent to receive and send information, including but not necessarily limited to meeting notices, ballots, and other information regarding CGSRC, via electronic transmission (fax and/or email), until such time as this consent is revoked in writing. This consent also allows CGSRC to conduct meetings via electronic transmission.

Liability Release Agreement and Waiver

I am familiar with swimming and the College Greens Swim and Racquet Club and its various clinics, lessons, fundraisers, and outside recreational activities (collectively, the “College Greens Swim and Racquet Club,” or “CGSRC”), and in consideration of being permitted to participate in activities at the CGSRC, agree with the CGSRC as follows:

I hereby waive, release and discharge on behalf of myself, my spouse, my child(ren) and/or my ward(s) (the “Releasors”), any and all claims, demands, causes of action for damages, personal injury, death or damage or loss to  property which Releasors may have as a result of the participation of any Releasors in activities at the CGSRC. This Liability Release Agreement and Waiver shall inure to the benefit of the CGSRC and each of its coaches, participants, employees, agents, officers, volunteers, and directors (the “Releasees”). This liability release and waiver is intended to and shall discharge in advance the Releasees from any and all liability to the Releasors, and any and all third persons arising out of or in any way connected with participation in activities at the CGSRC, whether or not any liability may arise out of passive or active negligence, carelessness or omission on the part of the Releasees. It is agreed that participating in activities at the CGSRC involves an element of risk. I understand that incidents, including events of a serious and life-threatening nature, occur during swimming events, around swimming pools, and during the use of swimming pools due to, not by way of limitation, slips, falls, collisions, drowning, and other water-related hazards. Knowing the risks involved in the activity of swimming, the Releasors hereby expressly assume all such risks. Releasors also assume all risks associated with other aspects of the CGSRC, including without limitation recreational activities, fundraisers, and other events sponsored by or affiliated with the CGSRC or its coaches, parents or volunteers. Releasors further agree to hold the Releasees harmless and shall defend and Indemnify them from any loss, liability, damage, cost or expense which they may incur (notwithstanding their own active or passive negligence or carelessness) as a result of any injury or death to person or damage to property which may be sustained by the Releasors while participating in activities at the CGSRC. This Liability Release Agreement and Waiver shall be binding on my heirs, successors and assigns. Releasors agree to accept and abide by the rules and regulations of the CGSRC

If any of the participants in the application for membership to the CGSRC is under the age of 18 years, I further represent that I have the authority to execute this document on the behalf of the participant(s); said participant(s) is/are physically able to participate in activities at the CGSRC and all of the terms of this Liability Release Agreement and Waiver shall apply in the event of death or injury or property damage which said participant(s) may sustain while participating in activities at the CGSRC

Photos: CGSRC reserves the right to photograph participants in activities at the CGSRC for potential future use. All photos will remain the property of the CGSRC and may be used on promotional materials, including the CGSRC website. 

Medical Release: The undersigned hereby authorizes the CGSRC to consent to any emergency medical care, which may be deemed necessary for the participants in the membership while under the supervision of the CGSRC. I understand that reasonable attempts will be made to contact me and/or the authorized contact person(s) listed on the membership application before using this consent. 

I HAVE CAREFULLY READ THIS LIABILITY RELEASE AGREEMENT AND WAIVER, AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY, INCLUDING FUTURE LIABILITY, AND A CONTRACT BETWEEN MYSELF AND THE COLLEGE GREENS SWIM AND RACQUET CLUB, AND I EXECUTE IT OF MY OWN FREE WILL.

Membership Policy Acknowledgement

  • I have reviewed and understand the CGSRC bylaws and articles of incorporation. 
  • I have reviewed the CGSRC membership policies and procedures. I understand a written notice is required and all dues must be current in order to resign from CGSRC membership. 
  • A member may cancel their membership at any time by submitting a written request (mail or email) to the Membership Director. Cancellation requests require a 30-day notice prior to becoming effective. After the 30-day period and the membership is cancelled by the Membership Director, all obligations for dues shall cease and all membership privileges shall be suspended. 
  • A member in good standing may inactivate their membership by submitting a written request (mail or email) to the Membership Director. Inactive status requests require a 30-day notice prior to becoming effective. After the 30-day period and the membership is deemed inactive by the Membership Director, all obligations for dues shall cease and all membership privileges shall be suspended. 
  • Memberships may be reactivated within 12 months of an inactivation request with full payment of all past membership dues, volunteer deposits, and late fees. If a waiting list exists, the individual or family will be placed at the top of the waiting list. 
  • Memberships may be reactivated beyond 12 months of inactivity without requirement of any past dues. If a waiting list exists, the household will be placed at the end of the waiting list and the initiation fee will be waived. 
  • I have reviewed and understand the CGSRC general guidelines. 
  • I have reviewed and understand the CGSRC guest policy.
